- HB 2441 | SB 6323 Concerning medical insurance premium reimbursements for surviving spouses of line of duty deaths

Under current law, survivors of LEOFF 2 members who are killed in the line of duty are eligible for health insurance through PEBB, and are reimbursed by LEOFF Plan 2 for their PEBB premium payments. However, these survivors are not eligible for medical insurance premiums for the time period from the member’s death to the death being determined by Labor and Industries to have been in the line of duty. Furthermore, once a survivor is Medicare eligible, they are required to enroll in Medicare to remain eligible for PEBB, however, they are not reimbursed for Medicare premiums. If enacted, this bill would reimburse surviving spouses of line of duty deaths for Medicare premiums Parts A and B, and for medical insurance premiums paid from the date of the member’s death to the death being determined to have been in the line of duty.

If enacted, this bill would make full-time wildland or aviation firefighters employed by the Department of Natural Resources eligible for membership in LEOFF 2. To be considered full-time they must be expected to be employed for at least 160 hours in a month for more than six months in the year.

- HB 2482 Permitting LEOFF 2 retirees to serve as chiefs of police in small police departments

If enacted, this bill would allow LEOFF 2 retirees who are serving as the chief of police for a city of fewer than 50,000 people the option to either reenter membership in LEOFF 2 or remain a retiree, forego service credit, and continue to receive their benefit.

- HB 2569 Clarifying eligibility for the tiered multiplier and alternative lump sum benefits in LEOFF 2

This bill would change the date for qualifying for having a choice between the lump sum or the tiered multiplier benefit enhancement, from 2/1/21 to 1/31/21. This would result in those who retired on 2/1/21 now having the option for the tiered multiplier, instead of only being eligible for the lump sum benefit.

- HB 2034 Concerning termination and restatement of LEOFF Plan 1

This bill terminates LEOFF Plan 1 effective June 30, 2029. Additionally, this bill does the following:
- 120% of the funding required to fully fund LEOFF 1 is transferred to the restated law enforcement officers’ and firefighters’ retirement system to continue to pay for LEOFF 1 benefits.
- After this transfer, the remaining assets of LEOFF 1 are reverted back to the plan sponsor, the State.
- Does not take away any existing benefits for LEOFF 1 members and beneficiaries.
- Provides a retirement incentive to the four-remaining active LEOFF 1 members, as of February 1, 2025.
- Creates a two-year statute of limitations for claims challenging the bill.
- Requires DRS to seek IRS approval of the termination.
Substitute House Bill 2034 makes the following changes:
- Removes a provision enabling active employees of LEOFF 1 to retire in-service prior to the transfer.
- Reduces the assets transferred from LEOFF 1 to the Restated LEOFF from 120 to 110 percent for fully funding the benefits of the new plan.
- First deposits $569 million in the Climate Commitment Account before depositing the remainder into the Pension Funding Stabilization Account.
- Recognizes that reversion of surplus assets to the state occurs only after actuarially sufficient assets have been transferred to the new plan.
- States that if required by the federal internal revenue service, any funds reverted back to the plan must be reverted back with interest.
- Adds funding policy language stating that if unfunded liability exists in the Restated LEOFF, a systematic policy of state contributions will be adopted to fully amortize the liability. Removes a provision enabling active employees of LEOFF 1 to retire in-service prior to the transfer.
