Windfall Elimination Provision (WEP) and Government Pension Offset (GPO) Repealed Social Security Fairness Act (H.R.82)

The Social Security Fairness Act, HR 82, concerning the Windfall Elimination Provision (WEP) and Government Pension Offset (GPO), was signed into law on January 5, 2025.

In addition to repealing the WEP and GPO, the bill also provides retroactive Social Security benefits for 2024 for public workers whose benefits were reduced due to the WEP or the GPO.

The Social Security Administration (SSA) is evaluating how to implement the Act and is expected to publish more details on how it plans to implement the law soon.

According to SSA, if you have previously filed for Social Security benefits you do not need to take any action now except to make sure that the agency (SSA) has your current mailing address and direct deposit information if your address has recently changed.

Most beneficiaries will be able to verify this information on their personal "my Social Security" account without calling or visiting Social Security. The agency recommends visiting www.ssa.gov/myaccount to sign in or create your account.
